Lawyer Files Suit For False Arrest Of Snowball Throwing

(MYFOX NATIONAL) - Attorney Neil Wollerstein is filing a false arrest and malicious prosecution suit of $10 million against the Bronx on behalf of his clients for being arrested for throwing snowballs reports the New York Daily News .

His clients, Johnathan Rodriguez, Manuel Rondon, Christian Perez, and Ariel Lopez were playing at a park in late February, throwing snowballs, when they say one snowball accidentally hit off-duty cop Adonis Ramirez in the leg. The boys say that Ramirez pulled out a gun and started waving it at them.

A NYPD source says Ramirez was in street clothes leaving a friends house when the incident occurred. The source says that Ramirez passed the group and they began taunting him. When they began running after him, he identified himself as a cop and called 911.

Ramirez said the boys taunted him, called him a name, and threatened to jump him. The boys deny Ramirez identifying himself as a cop.

The Web site Gothamist.com reports that the boys were arrested, brought down to Central Booking and charged with weapons possession, attempted assault, menacing and harassment.

The Daily News reports Rodriguez said, “When I was in Central Booking, people asked me what I was locked up for, and I said a snowball. Everyone started laughing.”

Wollerstein believes the DA's office is wasting their time and should be focusing on “real” crimes instead of going after these boys who were having fun at the park.

The group believes Ramirez is the one at fault and that he should be the one being reprimanded for his behavior. Rodriquez is filing a civilian complaint against Ramirez and wants the NYPD to discipline the edgy officer.

Perez told the Daily News , “He shouldn't be able to carry a gun again. I don't think he should be able work on the streets.”

The Bronx DA is not planning on dropping any of the charges.
